Justice James Omotosho, in a judgment, held that Shaibu lacked the locus standi (legal right).to challenge the outcome of the primary on the grounds that he did not fully participate in the primary.

The judge further held that the suit by Phillip Shaibu was premature because he failed to exhaust the internal dispute resolution mechanism of the party before heading for the court.

He said, as a member of the PDP, he was bound by the rules and regulations of the party, which requires an aggrieved aspirant at a primary to first approach the party’s appeal committee before filing a suit in court.

He held that there was sufficient evidence to show that Ighodalo actually won the primary.

The Edo governorship election is expected to hold on September 24 this year.

Shuaibu had in his suit prayed the Court to issue an order stopping the Independent National Electoral Commission, INEC, from accepting or recognizing Ighodalo as governorship candidate of PDP.

He also requested for another order to compel the PDP to conduct a fresh primary election.

His grouse was mainly that the provisions of the Electoral Act 2022 and PDP guidelines were violated in the conduct of the primary election
