Lagos doctor, Olaleye bags double life jail for defiling wife’s niece

An Ikeja Sexual Offences and Domestic Violence Court on Tuesday sentenced the embattled Medical Director of Optical Cancer Care Foundation, Dr Olufemi Olaleye, to double life imprisonment for defiling 16-year-old wife’s niece.

BRANDPOWER reports that Justice Rahman Oshodi held that the prosecution proved the two-count of defilement and sexual assault by penetration against Olaleye.

Oshodi said that the evidence adduced before the court against the defendant was compelling and proved beyond reasonable doubts.

According him, the confessional statement of the defendant, which he made before his lawyer, Mr Olalekan Buruji and the DPO of Anthony Police Station that he regretted his act, proved that he committed the offences.

The judge said that the oral statement which the defendant denied, had the NBA seal of Buruji on it and his denial did not hold waters.

“You are dangerous offender  and  you must  be ashamed,” he said.

Oshodi described the medical director as a dangerous offender who did not show any sign of remorse during trial.

“You acknowledged that you are a sex addict in your confession, but came to this court and told lies.

“You showed no remorse, and it shows that you are a dangerous man.

“The survivor, to your knowledge, is a child but you forced her to watch pornography, rub her breasts and put your penis in her mouth.

“You penetrated her repeatedly,’’ Oshodi said.

The judge noted that Olaleye’s current counsel, Mr Adebisi Oridate, pleaded for the court’s leniency on the convict.

“By the laws of Lagos State, I am compelled to hand you a sentence of life imprisonment on each count of your offence, but your counsel has said that you are a first-time offender and a doctor of cancer patients.

“I hereby sentence you to life imprisonment on both counts one and two,” he said.

The judge directed that Olaleye should have his name written in the Sexual Offences Register of Lagos State Government.

Earlier, Oridate said: “He is a medical doctor who offers services to people suffering from cancer-related ailments, especially women.

“The state recognises his services and the defendant is a first-time offender.

“He has lost his business because he has been incarcerated, and, of course, his family.

“He has an aged mother who is dependent solely on him. We pray your lordship to temper justice with mercy.”

NAN reports that prosecution team led by Lagos State Director of Public Prosecutions, Dr Babajide Martins, had submitted that Olaleye sexually assaulted his wife’s niece for about 19 months until the wife discovered and reported to the police.

The survivor was living with the Olaleye family when the medical director defiled her, according to the prosecution team which called six witnesses.

Defence called three.

The offences contravene the provision of Sections 137 and 261 of the Criminal Law of Lagos State, 2015.

BRANDPOWER recalls that The defendant’s wife, Aderemi Olaleye, in her testimony before the court had stated, “My lord, on 27th November 2021, my niece told my aunty that since March 2020, Femi has been sexually abusing her and even introduced her to pornography. From there, he graduated to oral sex with her and he does this in different places in the home where there are no cameras”.

But Dr. Olaleye had countered this evidence, stating that the allegation surfaced after the couple had a serious misunderstanding.

The defence witness told the judge that the marriage between the couple was a rocky relationship because of his wife’s deceptions and an extra-marital affair.

The defendant, who referred to his wife, as Mrs. Anthonia Ijeoma Yetunde Fagbemi, further said, “During the course of the marriage, Anthonia, I mean (Remi) continued to have extra-marital affairs, she also took a loan to buy a car”.

The defendant told the court that he shared the same bedroom with his wife on the second floor of their two-storey building and had 16 Close Circuit Television (CCTV) cameras installed in the house.

Olufemi Olaleye said, “For security purposes, I installed four internal and four external CCTV cameras but shortly after the girl started living with us, my wife compelled me to install additional eight cameras.

“The CCTV cameras cover all angles, every room with the exception of toilets. There are two CCTV cameras in my bedroom alone,” he said.

His wife, Mrs Aderemi Fagbemi-Olaleye had however countered in her oral testimony.She had said: “My niece confessed to my aunt, Theresa Osodi that my husband, Femi, initially introduced her to pornography; from there, it graduated to oral sex which he was doing around 2.00 a.m. on a daily basis.

“She said that he switched off the camera so that I would not notice anything. She told my aunt that Femi would unzip his trousers and bend down her head into his penis.

“After that, he would say, ‘Thank you, my dear; I am saving for you’.

“ This, according to her, went on from March 2020 to November 2021.

“She said that the oral sex graduated to normal sex, and that Femi would put her on the table in the study room and have sexual intercourse with her and threaten to eliminate her and every other person in the house if she would dare to tell anyone about the sex escapades,’’ the witness said.

She testified that, one day, the survivor confided in the family driver, Mr Waheed Yusuf, who met her spitting behind the family’s house.

“She cried and confided in Yusuf, who wanted to confront Femi; she held him and begged him not to tell anyone because Femi had threatened to kill her and every other person.’’

She said that her husband broke down in tears in the presence of his lawyer, Mr Olalekan, admitting having sexual intercourse with the minor.

“Femi broke down in tears and confessed to having sexual intercourse with my niece.

“Femi, in one of his apology emails and text messages, told me that my niece was a blessing to him, that if she was not living with us, he would probably be sleeping with my daughter,’’ she told the court.

She testified that the survivor was sent to the Mirabel Medical Centre for examination and was referred to a psychologist.

The witness also accused her husband of giving her sleeping tablets.

“I did not know any of these allegations until everyone in my family knew. My lord, most nights, Femi gave me small tablets of aspirin.

“There was a time we had a visitor, Aunty Bridget, who slept in the guest room and my niece decided to sleep with her.

“Unknown to Femi that we had a visitor, he tiptoed to the guest room thinking it was only my niece who was sleeping there, and removed her wrapper.

“Bridget shouted and he apologised, saying that he was checking on everyone,” she said.

The witness denied the claim that she set up her niece against her husband.

“How can I set up a 15-year-old child to destroy the father of my children? I do not have anything to gain.

While being cross-examined by defence counsel, Mr Babatunde Ogala (SAN), the witness said that Ogunnubi told her that her husband was diagnosed with sex addiction.

“Our sex life as couple was great; I was surprised that my niece gave him oral sex because he told me he never liked oral sex.

“I share the same bedroom with my husband, and I go to bed at 9.00 p.m. after praying with the children, my niece inclusive.

“My husband, sometimes, says he wants to stay back and watch television,” she said.
